Terms of Service
These Terms of Service (“Terms”) govern your purchase and use of DAD — Dash Auto Download (“DAD”, “the App”, “the Service”), published by Nogueira Driver Development LTDA, a company registered in Brazil and doing business as Overcut Academy (“we”, “us”). By subscribing to or using DAD, you agree to these Terms. If you do not agree, do not use the Service.
1. License grant
Subject to an active subscription and these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use DAD on the number of computers permitted by your plan, for your own karting/racing operations. All rights not expressly granted are reserved.
You may not (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble it except to the limited extent permitted by law; (c) rent, lease, sublicense, resell, or share your license key; or (d) remove proprietary notices. Your license key and activations are personal to your subscription.
2. Plans, dashes, and laptops
Each plan tier sets a maximum number of dashes DAD may download from and a maximum number of activated laptops. You can release a laptop or dash slot by deactivating it in the App, or by contacting support. Exceeding your plan's limits may require upgrading to a higher tier.
3. Subscription, billing, and renewal
- Billing. Subscriptions are sold on a weekly, monthly, or yearly basis. Payments are processed securely on our behalf by our payment provider Stripe (operated in Brazil by Stripe Payments do Brasil Instituição de Pagamento Ltda.). Payment is charged at purchase and automatically at the start of each renewal period.
- Auto-renewal. Your subscription renews automatically until you cancel. By subscribing you authorize recurring charges to your payment method.
- Cancellation. You may cancel anytime via the customer billing portal link included in your purchase receipt, or by contacting support. Cancellation takes effect at the end of the current paid period; your license keeps working until then.
- Refunds. New customers are covered by a 14-day money-back guarantee on a first subscription; otherwise renewals and the unused portion of a paid period are non-refundable except where required by law. See our Refund Policy for full details.
- Failed payments. If a renewal payment fails, your license may be suspended until payment succeeds. If a successful payment is later received, service is restored.
- Price changes. We may change prices; changes apply to future renewal periods and we'll provide notice as required.
4. Acceptable use
You represent that you own or are authorized to access the dashes you connect DAD to and the data you download. You agree to use DAD lawfully and not to interfere with the Service or attempt to circumvent license enforcement.
5. Your data and files
Session files DAD downloads are stored on your own computer and remain yours. Our handling of the limited account data we collect is described in our Privacy Policy.
6. Intellectual property
DAD, the DAD name, and all associated software and content are owned by Nogueira Driver Development LTDA (Overcut Academy). “Mychron” and “AiM” are trademarks of AiM Tech S.r.l., and “Unipro” and “UNIGO” are trademarks of Unipro ApS, each of their respective owners; DAD is an independent product and is not affiliated with, endorsed by, or sponsored by AiM Tech S.r.l., Unipro ApS, or their brands.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that every download will succeed for every dash, firmware, or network configuration.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Suspension and termination
We may suspend or revoke your license if you breach these Terms, if a chargeback or payment dispute is opened, or if your subscription lapses. You may stop using DAD at any time by cancelling and uninstalling. Sections that by their nature survive termination (IP, disclaimers, liability, governing law) survive.
10. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising out of or in connection with these Terms will be resolved in the competent courts of the Comarca de Belo Horizonte, Minas Gerais, Brazil. Nothing in these Terms limits any non-waivable consumer rights you have under applicable law, including the Brazilian Consumer Protection Code (Lei nº 8.078/1990).
11. Changes
We may update these Terms from time to time. Material changes will be reflected by an updated effective date. Continued use after changes constitutes acceptance.
