Terms of Use
These Terms of Use (“Terms”) govern your use of the BestLap mobile application (“App”) published by Overcut Academy (“we”, “us”). The App is currently distributed on the App Store under the personal Apple Developer account of Lucas Nogueira, the company’s founder, while we transition to an Organization Apple Developer account. By installing or using BestLap, you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use BestLap on Apple devices that you own or control, solely for your personal, non-commercial use, in accordance with the Apple Media Services Terms (the “Usage Rules”). All rights not expressly granted are reserved.
You may not (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App, except to the limited extent permitted by applicable law; (c) rent, lease, sublicense, or sell the App; or (d) remove any proprietary notices.
2. Subscription terms
BestLap offers a “BestLap Pro” auto-renewable subscription:
- Free tier: 1 stopwatch, full export functionality, all settings.
- Pro tier (BestLap Pro Yearly): up to 8 simultaneous stopwatches and all future Pro features.
- Free trial: new subscribers receive a free trial period (length disclosed in the App and App Store at the time of purchase). At the end of the trial, the subscription auto-renews at the price disclosed at purchase.
- Renewal: the subscription renews automatically every year unless you cancel at least 24 hours before the current period ends. Apple charges your Apple ID at confirmation of purchase and at each renewal.
- Cancellation: manage or cancel anytime in iOS Settings → [your Apple ID] → Subscriptions. Cancellation takes effect at the end of the current paid period; no partial refunds for unused time.
- Price changes: if we change the subscription price, Apple will notify you and require you to confirm before renewing at the new price.
Payment is charged to your Apple ID account at confirmation of purchase.
3. Use of the App
You agree to use the App in compliance with all applicable laws. The App is a passive stopwatch; you are solely responsible for safe operation of any vehicle and for your physical surroundings while using it. Do not operate this App while driving.
4. Intellectual property
BestLap, the BestLap name and logo, and all associated content are owned by Overcut Academy. You retain ownership of any data you enter (driver names, session notes, etc.).
5. Disclaimers
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that lap-time measurements are accurate to any specific tolerance. The App is intended as a training and review aid, not as official race timing.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7. Apple-specific terms
You acknowledge that these Terms are between you and Overcut Academy, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance and support for the App. In the event of any failure to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price; Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
8. Termination
We may suspend or terminate your access to the App if you breach these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (IP, disclaimers, liability, governing law) survive.
9. Governing law
These Terms are governed by the laws of the State of California. Any dispute will be resolved in the competent courts of that jurisdiction.
10. Changes
We may update these Terms from time to time. Material changes will be reflected by an updated effective date. Continued use after changes constitutes acceptance.
